Earlier this week, a panel of federal judges—15 of whom were appointed by Obama and Biden—caved to pressure from far-left Democrat leader Hakeem Jeffries and voted to oust Habba as interim U.S. Attorney. Their reasoning? Pure political retaliation after Habba dared to indict Democrat Rep. LaMonica McIver, proving once again that the left only believes in “justice” when it benefits them. But Trump and Bondi were ready.

2) Trump withdraws Habba's nomination to take the job permanently
3) AG Bondi appoints Habba First Assistant US attorney
4) Habba automatically becomes acting US attoreny bc of the vacancy.

In a brilliant legal counterstrike, Habba resigned as interim U.S. Attorney just before her term expired, allowing Trump to withdraw her nomination for the permanent position. Bondi then swiftly appointed her as First Assistant U.S. Attorney, automatically making her the Acting U.S. Attorney due to the vacancy. This masterful play exploited the Federal Vacancies Reform Act, which bars Senate nominees from serving in an acting capacity—shutting down the left’s scheme cold.

The reason Trump has to withdraw her nomination is because the Federal Vacancies Reform Act prohibits the nominee for a Senate-confirmed office from holding the post on an "acting" basis.

The left’s meltdown was immediate. Politico’s Kyle Cheney whined about the maneuver, but the real outrage should be directed at the activist judges who illegally bowed to political pressure. As Mike Davis of the Article III Project declared, “These New Jersey activist judges violated Canons 2, 3, and 5 of the Code of Conduct for United States Judges.” In other words, they abandoned impartiality to serve as Democrat operatives in robes.
