In a bold political move, Rep. Joe Morelle (D-N.Y.) has announced his intention to introduce a constitutional amendment aimed at countering the recent Supreme Court ruling. This ruling notably granted former presidents significant protection against criminal prosecution for actions taken during their term in office.

The Supreme Court’s 6-3 decision, delivered on Monday, solidified that presidents are granted absolute immunity for actions integral to their office’s core responsibilities. They are also ‘at least presumptively immune’ from all other official acts.

The ruling was indeed a triumph for former President Trump, as it essentially returned his federal election subversion case in Washington, D.C., to a lower court. The court is now tasked with determining whether his actions on January 6 warrant protection from criminal prosecution.

Reacting audaciously, Morelle took to social media platform X to announce his plan to introduce a constitutional amendment. ‘I will introduce a constitutional amendment to reverse SCOTUS’ harmful decision and ensure that no president is above the law. This amendment will do what SCOTUS failed to do—prioritize our democracy,’ Morelle stated.

Several Democrats have voiced their criticism of the Supreme Court’s ruling, arguing that it undermines the fundamental principle that no one, including the president, is above the law.

They contend that the Supreme Court’s interpretation is at odds with our nation’s founders’ intentions.

Justice Sonia Sotomayor, who wrote the dissent joined by two other liberal justices, highlighted the gravity of the ruling by stating, ‘In every use of official power, the President is now a king above the law.’

This sentiment has been echoed by Democratic leaders who argue that the ruling grants presidents excessive immunity, thereby compromising the accountability crucial to a functioning democracy.

Given that the Supreme Court’s judgment on a constitutional issue is virtually final and can only be altered by a constitutional amendment or a new ruling, Morelle’s proposed amendment aims to overturn the Court’s decision and reaffirm that no president is above the law.

Morelle’s action represents a significant response from Democrats committed to maintaining presidential accountability. The proposed amendment is likely to spark further debate and scrutiny as it moves through the legislative process.
